However, this protection does NOT apply to CDL holders. Federal DOT regulations explicitly supersede state cannabis laws for all safety-sensitive transportation workers. The New York Department of Labor guidance confirms: employers CAN drug test employees when "federal or state law requires drug testing or makes it a mandatory requirement"—which includes all DOT-regulated CDL drivers.
