Michigan legalized recreational marijuana in 2018 under the Michigan Regulation and Taxation of Marihuana Act. However, Michigan employers — including trucking companies — are NOT required to accommodate marijuana use and may still enforce drug-free workplace policies under MCL 333.27954. More importantly, federal DOT regulations under 49 CFR Part 40 completely override Michigan state marijuana law for CDL holders. A Michigan marijuana card provides zero protection from a positive DOT drug test. If you hold a CDL and operate in interstate commerce, you are subject to federal drug testing — period. Having a Michigan recreational marijuana card will not help you pass your return-to-duty test or prevent your prohibited status in the FMCSA Clearinghouse.
