Michigan legalized recreational marijuana in 2018 under the Michigan Regulation and Taxation of Marihuana Act. However, Michigan employers — including trucking companies — are NOT required to accommodate marijuana use and may still enforce drug-free workplace policies under MCL 333.27954. More importantly, federal DOT regulations under 49 CFR Part 40 completely override Michigan state marijuana law for CDL holders.
